Terms of Service

1. Introduction

Welcome to InkSpot. InkSpot is a digital marketplace platform that connects tattoo artists, tattoo studios, and users seeking tattoo services worldwide. Our platform provides tools for profile creation, portfolio showcasing, booking management, and communication between parties.

These Terms of Service ("Terms") govern your access to and use of InkSpot's website, mobile applications, and services (collectively, the "Platform").

2. Acceptance of Terms

By accessing or using InkSpot, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Platform.

You must be at least 18 years old to use InkSpot. By using the Platform, you represent and warrant that you meet this age requirement.

3. User Accounts

Account Creation

To access certain features of InkSpot, you must create an account. When creating an account, you agree to:

  • Provide accurate, complete, and current information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access or security breach

Account Responsibility

You are responsible for all activity that occurs under your account. Artists and studios are solely responsible for the accuracy of their profiles, portfolios, pricing, availability, and the quality of services they provide. InkSpot does not verify the credentials, qualifications, or work quality of artists or studios listed on the Platform.

4. Platform Role

InkSpot is a Marketplace Platform Only. It is important to understand that:

  • InkSpot does NOT provide tattoo services – we facilitate connections between users and service providers
  • InkSpot is NOT a party to agreements between users and artists/studios
  • InkSpot is NOT responsible for the quality, safety, or outcomes of tattoo services provided through the Platform
  • InkSpot is NOT liable for disputes, injuries, or damages arising from interactions or transactions between users and artists/studios
  • All agreements, terms, and payments for tattoo services are made directly between users and artists/studios

Users are solely responsible for evaluating artists and studios, verifying credentials, and ensuring compliance with local health and safety regulations.

5. Subscriptions & Payments

Subscription Plans

InkSpot offers subscription plans for different user types:

  • User Premium: Enhanced features for clients seeking tattoo services
  • Artist Pro: Professional tools for tattoo artists
  • Studio Pro: Advanced features for tattoo studios

Pricing and Billing

  • Subscription fees vary by role and plan selected
  • All payments are processed securely through Stripe, our third-party payment processor
  • Subscriptions are billed on a monthly recurring basis
  • Your subscription will automatically renew at the end of each billing period unless cancelled
  • You can cancel your subscription at any time through your account settings

Price Changes

InkSpot reserves the right to modify subscription prices at any time. We will provide at least 30 days' notice of any price changes. Continued use of the Platform after a price change constitutes acceptance of the new pricing.

Payment Information

By providing payment information to Stripe, you authorize InkSpot to charge your payment method for subscription fees. InkSpot does not store your credit card or payment details – all payment data is securely handled by Stripe in accordance with their terms and privacy policy.

6. Refund Policy

Subscription fees are generally non-refundable. This includes:

  • Partial billing periods when you cancel mid-cycle
  • Unused subscription time remaining after cancellation
  • Fees paid for previous billing periods

You may cancel your subscription at any time. If you cancel during the 7-day free trial, no subscription fee will be charged. Once a subscription payment has been successfully charged, it is non-refundable; after cancellation, paid features remain available until the end of the current billing period, and the subscription does not renew for the following period. Refunds are issued only for duplicate charges, incorrect charges caused by a technical error, or where required by applicable law. If you believe you are entitled to a refund, please contact us at contact@inkspot.world.

Note: This refund policy applies only to InkSpot subscription fees. Booking deposits paid through the Platform are governed exclusively by our Deposit Policy: deposits are non-refundable when the client cancels, does not attend, or postpones the appointment, and remain payable to the booked artist or studio. InkSpot acts solely as a marketplace intermediary and is not the provider of the tattoo service.

7. User Content

Content Ownership

You retain all ownership rights to content you upload, post, or share on InkSpot ("User Content"). This includes profile information, portfolio images, reviews, and communications. By uploading User Content, you grant InkSpot a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content on the Platform for the purpose of providing our services.

Content Standards

You agree that your User Content will not include:

  • Illegal, harmful, or offensive material
  • Content that infringes on intellectual property rights or copyrights
  • Misleading, deceptive, or fraudulent information
  • Content that promotes violence, discrimination, or harassment
  • Explicit or inappropriate sexual content
  • Spam, advertising, or promotional material unrelated to tattoo services

Content Removal

InkSpot reserves the right to remove, edit, or refuse to display any User Content that violates these Terms or is otherwise objectionable, without prior notice.

8. Prohibited Use

You agree not to engage in any of the following prohibited activities:

  • Misuse of the Platform: Using InkSpot for purposes other than connecting with artists/studios or finding clients
  • Fraud: Providing false information, impersonating others, or engaging in fraudulent transactions
  • Harassment: Harassing, threatening, or abusing other users
  • Spam: Sending unsolicited messages or promotional content
  • Illegal Activity: Using the Platform for any illegal purpose or in violation of local laws
  • Copyright Infringement: Uploading content you do not own or have permission to use
  • System Interference: Attempting to interfere with, disrupt, or compromise the Platform's security or functionality
  • Data Scraping: Using automated tools to scrape or extract data from the Platform
  • Bypassing Restrictions: Circumventing account restrictions or subscription requirements

9. Account Suspension & Termination

InkSpot's Right to Suspend or Terminate

InkSpot reserves the right to suspend, restrict, or terminate your account at any time, with or without notice, for any of the following reasons:

  • Violation of these Terms of Service
  • Fraudulent, abusive, or illegal activity
  • Uploading prohibited or inappropriate content
  • Multiple complaints from other users
  • Non-payment of subscription fees
  • Any conduct that InkSpot deems harmful to the Platform or its users

User-Initiated Termination

You may terminate your account at any time through your account settings or by contacting us. Upon termination, your access to the Platform will be revoked, and your data may be deleted in accordance with our Privacy Policy.

Effect of Termination

Upon account termination, you will lose access to your profile, portfolio, bookings, and other data associated with your account. InkSpot is not liable for any loss of data resulting from account suspension or termination.

10. Limitation of Liability

To the fullest extent permitted by law:

  • InkSpot provides the Platform "as is" without warranties of any kind, express or implied
  • InkSpot is not liable for any indirect, incidental, special, consequential, or punitive damages
  • InkSpot's total liability shall not exceed the amount you paid to InkSpot in the past 12 months
  • InkSpot is not responsible for the actions, content, or services of third parties, including artists and studios

11. Indemnification

You agree to indemnify, defend, and hold harmless InkSpot, its officers, directors, employees, and affiliates from any claims, liabilities, damages, losses, or expenses arising out of your use of the Platform, violation of these Terms, or infringement of any third-party rights.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Switzerland.

13. Changes to These Terms

InkSpot reserves the right to modify or update these Terms of Service at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
